This Release and Waiver of Liability (“Release”) is entered into between the Volunteer and The Clear Islam, a division of the Al-Furqaan Foundation (“TCI”). The Volunteer desires to provide volunteer services to TCI and engage in activities related to serving as a volunteer. The agreement of the parties is as follows:
1. Volunteer Conduct
Volunteer acknowledges that Volunteer is serving as a public face for TCI as well as for Islam itself. The public’s perception of Islam is directly tied to Volunteer’s conduct while representing TCI. Volunteer agrees to act in a manner that reflects the moral guidelines of Islamic teachings and traditions. This means specifically that:
- Volunteer will not engage in any conduct that would harm the reputation or image of TCI or Islam itself.
- Volunteer agrees that Volunteer is not a member of or affiliated with any organization that is considered a terrorist organization by the U.S. or other governments.
- Volunteer agrees that Volunteer’s role is to represent TCI and Islam to the general public; Volunteer’s individual political beliefs are to remain at home while volunteering for TCI.
- Volunteer agrees that Volunteer will not engage in any illegal acts, participate in any offensive acts, or otherwise engage in conduct that does not reflect the moral guidelines of Islamic teachings.
- Volunteer acknowledges that Volunteer may encounter individuals whose goal is to disrupt Volunteer’s da’wah activities. Volunteer agrees that, even in the face of actual harassment, Volunteer will not take any actions that could reflect negatively on Al-Furqaan Foundation or Islam itself. This includes acts of physical or verbal aggression.
- Volunteer agrees that Volunteer will not be under the influence of or in possession of alcohol or drugs while representing TCI.
- Volunteer agrees that Volunteer will treat others with courtesy and respect while representing TCI.
- Volunteer acknowledges that Volunteer is not authorized to accept donations on behalf of Al-Furqaan Foundation. Volunteer will refer any potential donors to the TCI’s official website.
- Volunteer agrees to refrain from using profanity or other crude language while representing TCI.
2. Release and Waiver
Volunteer releases, discharges, and holds harmless TCI, its parent the Al-Furqaan Foundation, and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise from the services provided to TCI. Volunteer understands and acknowledges that this release discharges TCI from any liability or claim that Volunteer may have against TCI with respect to bodily injury, personal injury, illness, death, or property damage that may occur while volunteering.
3. No Employment
Volunteer accepts and understands that the scope of Volunteer’s relationship with TCI is limited to a volunteer position and that Volunteer is not a paid employee. Volunteer further acknowledges that TCI will not provide any benefits traditionally associated with employment to Volunteer. Volunteer agrees that Volunteer is responsible for their own insurance coverage in the event of personal injury or illness as a result of Volunteer’s services to TCI.
4. Medical Treatment
Volunteer acknowledges that TCI does not assume any responsibility for or obligation to provide Volunteer with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. Volunteer expressly waives any claims for compensation or liability on the part of TCI for any injury or medical expenses incurred by Volunteer.
5. First Aid Treatment
Volunteer releases and discharges TCI from any claim whatsoever arising from any first aid treatment or other medical services rendered in connection with an emergency occurring during Volunteer’s tenure as a volunteer.
6. Assumption of Risk
Volunteer understands and acknowledges that providing volunteer services to Furqaan may involve activities that carry inherent risks such as lifting materials and interaction with members of the general public. Volunteer acknowledges that such activities may result in personal injury, illness, property damage, or other harm.
Volunteer knowingly and voluntarily assumes all such risks, both known and unknown, associated with their participation as a volunteer, and agrees to accept full responsibility for any injury or loss that may occur as a result of such participation.
7. Photographic Release
Volunteer grants and conveys to TCI all right, title, and interest in any and all photographs, images, video, or audio recording of Volunteer or their likeness or voice made by TCI in connection with the provision of volunteer services to the same.
Volunteer expressly agrees that this release is intended to be as broad and inclusive as permitted by the laws of the State of Illinois, and this Release shall be governed by the laws of the State of Illinois. Volunteer further agrees that if any clause of this Release is declared invalid, the enforceability of the remaining provisions of this Release shall not be affected.
If executed in Canada, then Volunteer expressly agrees that this release is intended to be as broad and inclusive as permitted by the laws of Canada and the province of Ontario.
If executed in Mexico, then Volunteer expressly agrees that this release is intended to be as broad and inclusive as permitted by the laws of Mexico.
